One more slap by Central Government to State Government before Supreme Court against vaccine mandates.
In
a recent affidavit dated 13th January 2022 submitted before Supreme
Court on behalf of the Union of India which is affirmed by Dr. Veena Dhawan,
Joint Commissioner (UIP) in the ministry of Health & Family Welfare,
Government of India, it is once again made clear that:
(i) The vaccination is voluntary and no one
can be given vaccine against his wish.
(ii) No one should be required to carry &
show the vaccination certificate to any authority.
(iii) It is the duty of person giving vaccine
that, before giving vaccines each person should be informed about adverse side
effects of vaccines.
The
excerpts from the affidavit are as under;
“13…It is humbly submitted that the direction and guidelines released by Government of India and Ministry of Health and Family Welfare, do not envisage any forcible vaccination without obtaining consent of the concerned individual. It is further humbly submitted that vaccination for COVID-19 is of larger public interest in view of the ongoing pandemic situation. It is duly advised, advertised and communicated through various print and social media platforms that all citizens should get vaccinated and systems and processes have been designed to facilitate the same. However, no person can be forced to be vaccinated against their wishes.
14…It
is most respectfully submitted that the Government of India has not issued any
SOPs which make carrying of vaccination certificate mandatory for any purpose.
19.
Counselling before vaccination: It is humbly submitted that Government of India
has formulated Operational Guidelines for COVID-19 vaccination. As per these
Guidelines, all beneficiaries are to be informed about adverse events which may
occur after COVID-19 vaccine.”

Sorry, clarify, please, where in the affidavit is said that NO ONE should be required to carry & show the vaccination certificate to any authority?

DeleteYes, The question by the petitioner was specific to a particular group. But The answer is generic and broader indicating that the sub group ( disability) is included in the goi response.
DeleteBecause the document is a point by point response to petitioner it cannot create a new heading. But the response in para 14 makes the universal applicability of the ghideline pretty clear.
If you have doubt consult a lawyer
Where is it written that govt cannot mandate or coerce the certificate for entering public places or schools or offices or airports. It only says that they have not issued any SOP. it has not said that they have not asked states not to issue guidelines on their own.

ReplyDeleteVaccination is a protection circle to us. It is urgent for the senior citizens of all countries. One non vaccinated person may be spread out another persons as well as his/her family members.As a non family man PM MODI has taken the vaccine. He encourages all of indians. So there is no question of such statements. All steps have taken as per directions of CG.

ایک حالیہ حلف نامہ مورخہ 13 جنوری 2022 کو ہندوستان کی یونین کی جانب سے سپریم کورٹ میں جمع کرایا گیا جس کی تصدیق ڈاکٹر وینا دھون، جوائنٹ کمشنر (یو آئی پی) صحت اور خاندانی بہبود کی وزارت، حکومت ہند نے کی ہے، یہ ایک بار پھر واضح کیا کہ:
(i) ویکسینیشن رضاکارانہ ہے اور کسی کو اس کی مرضی کے خلاف ویکسین نہیں دی جا سکتی۔
(ii) کسی کو بھی ویکسینیشن سرٹیفکیٹ لے جانے اور کسی اتھارٹی کو دکھانے کی ضرورت نہیں ہونی چاہیے۔
(iii) یہ ویکسین دینے والے شخص کا فرض ہے کہ، ویکسین دینے سے پہلے ہر شخص کو ویکسین کے مضر اثرات سے آگاہ کیا جائے۔
حلف نامے کے اقتباسات حسب ذیل ہیں۔
“13…یہ عاجزی کے ساتھ عرض کیا جاتا ہے کہ حکومت ہند اور وزارت صحت اور خاندانی بہبود کی طرف سے جاری کردہ ہدایات اور رہنما خطوط، متعلقہ فرد کی رضامندی کے بغیر کسی زبردستی ویکسینیشن کا تصور نہیں کرتے ہیں۔ مزید عاجزی کے ساتھ عرض کیا جاتا ہے کہ جاری وبائی صورتحال کے پیش نظر COVID-19 کی ویکسینیشن وسیع تر عوامی مفاد میں ہے۔ مختلف پرنٹ اور سوشل میڈیا پلیٹ فارمز کے ذریعے یہ مناسب طریقے سے مشورہ دیا جاتا ہے، اس کی تشہیر کی جاتی ہے اور بات چیت کی جاتی ہے کہ تمام شہریوں کو ویکسین لگوانی چاہیے اور اس کی سہولت کے لیے نظام اور طریقہ کار وضع کیے گئے ہیں۔ تاہم، کسی بھی شخص کو ان کی خواہش کے خلاف ٹیکہ لگانے پر مجبور نہیں کیا جا سکتا۔
14… انتہائی احترام کے ساتھ عرض کیا جاتا ہے کہ حکومت ہند نے کوئی ایس او پیز جاری نہیں کیے ہیں جو کسی بھی مقصد کے لیے ویکسینیشن سرٹیفکیٹ کو ساتھ رکھنا لازمی قرار دیتے ہیں۔
19. ویکسینیشن سے پہلے مشاورت: یہ عاجزی کے ساتھ عرض کیا جاتا ہے کہ حکومت ہند نے COVID-19 ویکسینیشن کے لیے آپریشنل رہنما خطوط وضع کیے ہیں۔ ان رہنما خطوط کے مطابق، تمام استفادہ کنندگان کو COVID-19 ویکسین کے بعد ہونے والے منفی واقعات کے بارے میں مطلع کیا جانا ہے۔
